T3 Fabulous, Frizz-Free Honeymoon Hair Sweepstakes - 2008
This sweepstakes is sponsored by T3 Micro, Inc. (“Sponsor”). Sponsor reserves the right to cancel the Sweepstakes at any time and substitute another promotion in its place. Sponsor is not responsible for printing in these Official Rules.
A purchase does not improve your chance of winning. Void in Rhode Island, where prohibited, taxed or otherwise restricted by law and subject to all federal, state and local laws. This sweepstakes begins on Monday, April 14th, 2008, and ends on Friday, June 13th, 2008 (the "Promotional Period").
This Sweepstakes is open to all female legal residents of the United States and District of Columbia, U.S. Military personnel (and their families) with APO/FPO addresses, Alaska and Hawaii, who are twenty-one (21) years of age or older (void in Puerto Rico and Rhode Island) who must be engaged at the time of the entry. Participation in this Sweepstakes constitutes entrant's full and unconditional acceptance of these Official Rules.
Employees and their immediate families (parents, brothers, sisters and children) and people residing in the homes of the Sponsor, T3 Micro, Inc., its subsidiaries and affiliated businesses (including Orlo and Orlo Salon employees), distributors, advertising, PR and promotion agencies are not eligible to enter or win.
At the time T3 Micro, Inc. chooses the Grand Prize winner, she will be notified of the possible dates for the prize fulfillment (i.e. travel and hair consultation). The winner must be able to travel and receive the hair consultation on the dates specified by T3 Micro, Inc. in order to win the Grand Prize. If the winner is not available on the prize fulfillment dates specified by the Sponsor, the winner will be disqualified and the Sponsor may elect, at its sole discretion, to select an alternate winner. The prize fulfillment dates are subject to change by the Sponsor at is sole discretion.
There are two ways to enter the Sweepstakes -- (1) register online or (2) register via regular mail. Entries are limited to one entry per person.
Online registration: To enter the Sweepstakes, fill out the online registration form at www.honeymoonhair.com and provide via e-mail a legible photograph (headshot) and why you want to have fabulous honeymoon hair (in 200 words or less). Participants entering must provide a valid e-mail address and phone number. It is the sole responsibility of the entrant to notify the Sweepstakes judges in writing if the entrant changes her e-mail address. (To do so write to: honeymoonhair@t3micro.com. In case of dispute as to the identity of a winner, the winner will be deemed to be the person who is the authorized account owner of the e-mail address submitted in the winning entry. All Internet access and usage charges are the responsibility of the entrant. If for any reason the Internet portion of the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to terminate, modify or suspend the Sweepstakes. All entries received on-line before the on-line portion becomes inoperable will be included in the random drawing. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web-site, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes. In the event of a dispute, eligible electronic entries will be considered made by the authorized account owner of the email address submitted at the time of entry. Entries generated by robots or scripts are considered to be a direct violation of sweepstakes policy and will result in immediate disqualification of any and all associated entries.
Off-line Postal entry: To enter the Sweepstakes via regular mail, print your name, complete address, e-mail address (preferred but not mandatory), zip code, date and daytime telephone number on a 3 x 5 inch card or piece of paper. Also, a brief explanation of why you want to have fabulous honeymoon hair (in 75 words or less). Mail the card, explanation and photograph (legible headshot) in an envelope to: "T3 Honeymoon Hair Promotion" c/o T3 Micro, Inc., 428 Springfield Ave., 2nd floor, Summit, NJ 07901. Such alternate means of entry must be postmarked no later than June 13, 2008 and received by June 30, 2008. All mail-in entries must be legible when submitted in original hand-printed form. Any entry that does not use the official entry form or the 3 x 5 inch card as described herein, are void. Sponsor is not responsible for lost, late, misdirected, postage due, damaged, mutilated, illegible or incomplete entries. Sponsor is not responsible for returning photograph.
• One Grand Prize Winner will receive travel arrangements and overnight accommodations (minimum of a 3 star hotel) for a two-night stay for two in New York City, where she (and her guest of choice) will receive a hair consultation at Orlo Salon with Orlando Pita or one of his premier stylists. Grand prize winner will also receive $500 in cash (to cover daily expenses, provided by T3 Micro, Inc. prior to the trip) and a $200 shopping spree at Sephora.
All travel arrangements and overnight accommodations will be dependent on availability and selected by the Sponsor at its sole discretion.

Maximum total value of all prizes: $4119. Winner acknowledges that except and to the extent that the Sponsor cannot by law exempt itself from responsibility or liability, the Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee described herein; including, but not limited to, quality, merchantability, mechanical condition or fitness for use. All warranties are hereby disclaimed, and the winner will accept the prize "as is". Prizes cannot be assigned, transferred, exchanged or redeemed for cash.
Winners are solely responsible for the reporting and payment of all tax liabilities incurred. Winners must submit an affidavit of eligibility and compliance with the Official Rules. Failure to do so within fourteen (14) days of receipt of such documents will result in disqualification and the selection of an alternate winner.
Note: All T3 tools awarded will have North American plugs and North American voltage.
During the Promotional Period, eligible entries received on-line at T3’s HoneymoonHair.com website will be combined with the eligible mail entries received, to create the entry pool. Prize Winners will be selected on approximately July 1, 2008 after the end of the Promotion Period by random drawing by T3. Winners will be contacted and notified by a T3 representative using the contact information submitted during registration and supported by confirmation in writing. If T3 is unable to reach the winner within five days of the prize drawing using the information provided during registration, Sponsor may elect, at its own discretion, to select an alternate winner. Decisions regarding all aspects of the Sweepstakes shall be made by the Sponsor and are final and binding. The odds of winning a prize will be determined by the number of entries received. Odds of winning are equal regardless of the method of entry. To check if you are a winner (available after July 1, 2008), send a self-addressed, stamped business size (#10) envelope to: T3 Honeymoon Hair Promotion, 428 Springfield Ave., 2nd Floor, Summit, NJ 07901. (VT residents may omit return postage). All requests for Winner confirmation must be received by September 30, 2008.
Except where prohibited, acceptance of a prize shall constitute and signify a winner’s consent and grant of license to the use of her name, address (city and state only), written materials, voice, photograph and/or likeliness for commercial, advertising and promotional purposes, in all forms of media (including but not limited to periodicals, posters, television, film, Internet, print media), in perpetuity, including but not limited to posting on Sponsor’s website, without additional compensation or approval (where lawful).
If a winner declines to accept a prize, or in the event that a prize or prize notification is returned as undelivered, the winner will be disqualified and the Sponsor may elect, at its own discretion, to select an alternate winner. By participating, entrants release Sponsor, its parent, subsidiaries, affiliated businesses, its advertising and promotion agencies and the officers, directors, employees and agents of each from any and all liability, damages or causes of action (however named or described) for injuries, damages or losses to persons and property which may be sustained in connection with receipt, enjoyment, ownership or use of the prizes won.
This Sweepstakes and these Official Rules are governed by the laws of the State of California. Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; any judicial proceeding shall take place exclusively in a federal or state court within the State of California and the entrant submits to the jurisdiction of such court; and entrant will not assert, by way of motion, as a defense, or otherwise, in any action, suit or proceeding, any claim that such entrant is not subject personally to the jurisdiction of such court in an inconvenient forum, that the venue of the action, suit or proceeding is improper or that the Official Rules or the subject matter hereof may not be enforced in or by such court; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California. Each entrant further agrees not to assert, by way of motion, as a defense, or otherwise, in any action, suit or proceeding, any claim that such party is not subject personally to the jurisdiction of such court in an inconvenient forum, that the venue of the action, suit or proceeding is improper or that this Agreement or the subject matter hereof may not be enforced in or by such court. Each party further irrevocably submits to the jurisdiction of any such court in any such action, suit or proceeding.

In order to validly enter and in order to claim a prize, entrants are required to provide Sponsor with certain personally identifiable information such as name, address, daytime telephone number, e-mail address and/or other contact information. Such information may be used by Sponsor for providing product updates and marketing purposes and shared with Sponsor’s affiliates, advertising and promotional partners and other third parties. Entrants wishing that the Sponsor not contact them via postal mail, electronic mail and/or by via telephone (except in connection with the Sweepstakes) may elect to opt-out of such disclosures (i.e., they may direct Sponsor not to make those disclosures —other than those as to which "opting out" is not permitted) by contacting us by e-mail at honeymoonhair@t3micro.com and indicating to us the means by which Sponsor may and may not contact you and for what purposes (except that contact shall be permitted in connection with the Sweepstakes and as permitted or required by law).
